Meeting of the Council of Ministers on January 11th, 2023

The Council of Ministers met, at the Government Palace, in Dili, and approved two draft Decree-Laws presented by the Minister of Higher Education, Science and Culture, Longuinhos dos Santos, for the:

  • first amendment to Decree-Law no. 23/2014, of September 3rd, which approves the Statute of the National Institute of Science and Technology (INCT- Portuguese Acronym).

The purpose of this decree-law is to harmonize Decree-Law no. 23/2014, of September 3rd, which approved the INCT Statute, with Decree-Law no. 30/2020.

The project also provides for the establishment of a new Ethics Committee and new national directorates and respective research units.

It will also be better adapted in the pursuit of its attributions in the defence of science and development of Timor-Leste.

  • first amendment to Decree-Law no. 22/2016, of June 22nd, which approves the Legal Regime of Legal Deposit of Publications in Timor-Leste.

With this draft Decree-Law, the National Institute of Science and Technology is given the responsibility, in a transitory or temporary way, of managing the Legal Deposit Service while the National Library of Timor-Leste does not start its effective operation.

The Council of Ministers approved the draft Deliberation, presented by Prime Minister, Taur Matan Ruak, concerning the regularization of rent payments relative to the lease of the State property referred to in the Special Investment Agreement approved by Government Resolution no. 22/2010, of April 14th.

The services of the competent government department will carry out the necessary administrative procedures to ensure the collection of the amounts to be paid by the foreign investor, following the provisions of the Special Investment Agreement approved by Government Resolution no. 22/2010, of April 14th.

Also approved was the draft Decree-Law, presented by the Minister of Finance, Rui Augusto Gomes, on the establishment of the National Procurement Commission (CNA-Portuguese Acronym), I.P., which approves its statutes.

Over a decade after the establishment of the National Procurement Commission and given the volume and complexity of the procurement procedures instructed by the CNA, it is necessary to increase the management capacity and autonomy of the CNA, to increase the efficiency and effectiveness of the Public Administrative Sector’s procurements and the response capacity of the National Procurement Commission.

Given also that Decree-Law 22/2022 of May 11th, has extended the CNA’s attributions, it is now important to adapt its nature and resources to its tasks, through its transformation into a public legal person, in the form of a public institute.

The Council of Ministers approved the draft Decree-Law, also presented by the Minister of Finance, on the Execution of the 2023 General State Budget.

This draft Decree-Law aims to establish the rules regarding the execution of the 2023 General State Budget. Following the changes implemented in recent years as part of the public financial management reform, this decree-law aims to simplify budget execution procedures and implement the first phase of the decentralization of payment functions from the Directorate General of the Treasury to the Ministries and Secretariats of State, to facilitate the execution of the General State Budget by the services and entities of the Public Administrative Sector.

Also approved was the draft Law Proposal, presented by the Vice-Minister of State Administration, Lino de Jesus Torrezão, for the fifth amendment to Law 6/2006, of December 28th, which approves the Electoral Law for the National Parliament.

The purpose of this Law Proposal is to incorporate the innovations introduced in 2021 to the Electoral Law for the President of the Republic into the Electoral Law for the National Parliament, to ensure a greater legislative harmonization between the laws regulating the election of these sovereign bodies. Thus, it is intended to introduce new measures to encourage the democratic participation of Timorese citizens living abroad, such as the introduction of postal voting or the extension of the opening hours of polling stations, matters whose regulation is, by constitutional determination, subject to a legislative reserve.

This was followed by a presentation given by the Prime Minister and Minister of the Interior, Taur Matan Ruak, and the Vice-Minister of the Interior, António Armindo, on the political-legislative options underlying the establishment of the new Highway Code.

The political-legislative options presented aim to establish new rules for vehicle circulation on the roads, to promote road safety for all road users.

Lastly, the Minister of Health, Odete Maria Freitas Belo, presented to the Council of Ministers the political-legislative options underlying the establishment of the legal regime for the commercialization of breast milk substitutes.

To ensure safe and healthy food for children, the political-legislative options presented aim to allow the regulation of the commercialization of these products, with the analysis of their composition, as well as the regulation of the advertising of these products. END
