Meeting of the Council of Ministers on February 1st, 2023

The Council of Ministers met, at the Government Palace, in Dili and approved the draft Law Proposal, presented by the Vice-Prime-Minister and Minister of Planning and Territory, José Maria dos Reis, referring to the Measures for the Protection of Urban Legality.

With last year's approval of the legal regime for building and urbanisation, which has come to regulate the licensing of construction and the use of buildings, it has become necessary to provide the Government with the appropriate legal tools to ensure the application of that regime.

Thus, this draft Law Proposal aims to establish the measures to protect urban legality and to regulate the necessary administrative acts that guarantee compliance with the legislation on the licensing of urban planning operations, building, and compliance with territorial management instruments.

With this draft law, five measures will be established to protect urban legality - embargo, demolition, administrative eviction, cease of use and legalisation procedure - that will allow the Government to act and restore urban legality, taking into account the degree of seriousness of the urbanistic offence and the possibility or not of legalising the construction.

Also presented by the Vice-Prime Minister, the draft Government Resolution for the first amendment to Government Resolution n.º 15/2022, of April 6th, on the Determination of the elaboration of the Dili City Urbanization Plan was approved.

With this amendment, the possibility of extending the deadline for the elaboration of the Dili City Urbanization Plan is now foreseen, with justification, by the Minister of Planning and Territory, beyond the ten months previously set.

It is also specified that, for reasons of urgency, the Urban Plan will have a 30-day public discussion period.

The draft Decree-Law, presented by the Prime Minister, Taur Matan Ruak, for the first amendment to Decree-Law 3/2009, of January 15th, on the National Intelligence Service (SNI – Portuguese acronym), was approved.

The purpose of this draft Decree-Law is to increase the institutional capacity of the SNI by reorganising its structures and corresponding powers, making it more adaptable and more in line with current challenges and demands.

It also aims to clarify the rules regarding the organisational structure and to enable SNI staff to have their statute and a special career to improve their qualifications, thereby encouraging them to improve their performance in fulfilling their mission.

The Council of Ministers approved two drafts Decree-Laws, presented by the Minister of Transport and Communications, José Agustinho da Silva, regarding scheduled and non-scheduled international air transport.

The decree-laws aim to regulate the approvals for access to the market of scheduled and non-scheduled flights to ensure the safety of citizens and promote the organisation of this matter following the respective international regulations.

The decree-laws define the requirements, regulations, conditions and restrictions for the authorisation and activity of scheduled and non-scheduled international air transport.

The Council of Ministers approved the calendar for voter registration operations abroad, presented by the Minister of State Administration, Miguel Pereira de Carvalho.

Therefore, the training of members of the voter registration committees will take place on February 22nd and 23rd, 2023. Registering voters abroad will occur from February 24th to March 24th, 2023. The preparation, extraction, and dispatch of voters’ lists via electronic transmission from the diplomatic missions and consular posts will occur on March 25th and 26th. The period for displaying and complaining about the lists of voters registered abroad is set for March 27th to 31st, and the synchronisation of the voter registration system will take place between April 1st and April 11th. Lastly, the number of registered voters is expected to be published by April 12th, 2023.

Following the project presented by the Minister of Finance, Rui Augusto Gomes, and taking into consideration the recommendations of the Chamber of Accounts, the Council of Ministers has decided to close the bank account opened in 2018 with the Central Bank of Timor-Leste, held by the National Petroleum and Minerals Authority, related to the TL Cement project, and transfer the amounts deposited in this account to the Treasury account.

The Council of Ministers has approved the draft Government Resolution, presented by the Vice-Minister of Foreign Affairs and Cooperation, Julião da Silva, to suspend the decision of Timor-Leste's candidacy to the United Nations Human Rights Council for the period 2024-2026, adopted through Government Resolution no. 61/2021, of May 12th. Thus, Timor-Leste aligns its position with the ASEAN decision, which endorsed the Republic of Indonesia as the organisation's sole candidate for the Human Rights Council for the period 2024-2026, suspending its candidacy until the election of the Human Rights Council for the period 2027-2029.

Lastly, the draft Decree-Law, presented by the Vice Minister of Social Solidarity, Signi Chandrawati Verdial, for the second amendment to Decree-Law No. 37/2022, May 25th, on the end-of-year allowance to uma kain (households), was approved.

To guarantee the payment of this allowance to the claimants whose claims have been presented and accepted by the payment committee, the purpose of this draft Decree-Law is to extend the payment period until April 2023.

The deadline for the Minister of Social Solidarity and Inclusion to submit the report on the implementation of the decree-law to the Council of Ministers is also extended until June 30th, 2023. END
