Anti-Corruption Comission - ACC
Approved on 29 th of June 2009 by the National Parliament, the law that creates the Anti-Corruption Commission aims to give the competence to the State specialized criminal police, independent, that in its action will be based only on the criteria of legality and objectivity in articulation with the competent authorities, as it is important for its credibility as mechanism to combat corruption.
The corruption is one phenomenon with the negative consequence for social and economy life that affect the principle of Democratic State of Rule of Law and, given that fact, the IV Constitutional Government wrote and proposed to the National Parliament a legal framework for the Anti-Corruption Commission – (ACC).
This is a clear example of Government related to ethics, responsibility and transparency in governance according to the principle set out in the Constitution and reflecting the spirit of Convention of United Nations against corruption.
The ACC adopted an independent model in order to respect the initiatives of good governance, report to the Parliament and it is fully independent from the Executive of Xanana Gusmão. It has the power to begin and conduct criminal investigations related to corruption cases, according to the criminal code. Besides that, it has the equally role of education and public sensibility, by identifying and promoting the measures that prevent from corruption.
Aderito de Jesus was the voted name by the National Parliament for ACC commissioner. Besides being respected and recognized because, among others, as an important agent in writing the Constitution of Democratic Republic of Timor-Leste, as a lawyer, academic and activist of Human Rights and a man who has principle capable to behave independently, Aderito de Jesus has been elected to assume the position of the commissioner since February .
It is the first initiative of Government led by Kay Rala Xanana Gusmão that, by paraphrasing Government spokesman, Agio Pereira,“believe that Timor-Leste can succeed in answering the more seriously challenges of national independence through the determined adoption policies of combating the corruption, from which the Anti-Corruption Commission as an example”.
