The National Parliament approved today, February 9th, 2021, with 33 votes in favour, 10 votes against and 8 abstentions, the Legislative Authorization Law Proposal draft on the general bases of the Public Administration Organization.
This Law Proposal integrates a set of legislative initiatives, proposed by then Minister of Legislative Reform and Parliamentary Affairs, within the scope of legislative and administrative reform programs, which aim to improve the management and functioning of the public sector.
Given that the administrative organization is the instrument of the State to continue its tasks of public interest in meeting the collective needs of the population, it is essential to properly organize the State Public Administration, promoting the effectiveness of its performance.
The administrative organization must be coherent and homogeneous, facilitating the continuation of its activities through the interoperability and intercommunicability of human and material resources. It is intended that the organization of the State is as efficient as possible, organizing itself with the lowest cost possible, to free resources for material activities that directly aim at meeting collective needs. Finally, the administrative organization must satisfy the public interest and be subject to the law, while, adequately protecting citizens’ rights.
In the presentation of the Law Proposal, which preceded the overall debate, the Minister of the Presidency of the Council of Ministers, Fidelis Manuel Leite Magalhães, explained that “this authorization has as main objectives the harmonization, definition and organization of each of the public administration bodies and their respective competences” and further clarified that this Law Proposal “ has no relation with the Civil Service Commission Statutes or with the Law that creates the Civil Service Commission”.
After the entry into force of this Law, the Government has 180 days to define the bases of the organization of public administration.
